Everblue Properties LLC ("Everblue," "we," "our," or "us") respects your privacy. This Privacy Policy explains how we collect, use, share, and protect personal information when you visit everblueprops.com and any related pages and features (collectively, the "Site"), when you contact us, and when you book a vacation rental through the Site. By using the Site, you agree to the practices described in this Policy.

1. Information We Collect

Information You Provide

When you submit a contact, inquiry, rental question, availability request, or newsletter form on the Site, we collect the information you choose to share, which may include:

  • Your name;

  • Your email address;

  • Your phone number (optional, unless you ask us to reply by text/SMS);

  • The inquiry type you select (for example, "Property Owner," "General Inquiry," or "Rental Question");

  • The content of your message and any other details you choose to include;

  • Your communication preferences, including any consent you give to receive SMS/text messages (see Section 6).

Booking and Reservation Information

If you reserve a vacation rental through the Site, we and our reservations and payment providers collect the information needed to process and manage your booking, which may include your name, email address, phone number, stay dates, number of guests, the property selected, and billing details. Payment card details are collected and processed directly by our payment processor (Stripe) and our reservations platform (Guesty); we do not receive or store your full payment card number.

Information Collected Automatically

When you visit the Site, certain information is collected automatically through cookies and similar technologies, which may include:

  • IP address and approximate location derived from it;

  • Device and browser type, operating system, and screen resolution;

  • Pages viewed, time spent on the Site, referring URL, and other usage data;

  • Information collected by our bot- and abuse-protection provider (Cloudflare Turnstile) to distinguish human visitors from automated traffic (see Section 5).

2. How We Use Your Information

We use the information we collect to:

  • Respond to inquiries and provide the services you request;

  • Process, confirm, and manage vacation rental bookings and payments;

  • Send transactional messages (such as booking confirmations and responses to your inquiry) and, where you have consented, SMS/text messages;

  • Operate, maintain, secure, and improve the Site and our services;

  • Communicate with property owners, prospective owners, guests, and other contacts about their relationship with us;

  • Detect, prevent, and respond to fraud, abuse, spam, and unauthorized access;

  • Comply with our legal obligations and enforce our agreements.

3. How We Share Your Information

We do not sell your personal information. We share information only in the following circumstances:

  • Service providers. We share information with third parties that help us operate the Site and run our business, including hosting, database, email delivery, payment processing, reservations, analytics, and bot-protection providers. These providers are authorized to use your information only as needed to provide their services to us. See Section 4 for the specific providers we use.

  • Legal compliance. We may disclose information when we believe in good faith that disclosure is required by law, legal process, or to protect the rights, property, or safety of Everblue, our users, or others.

  • Business transfers. If Everblue is involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction, subject to standard confidentiality protections.

4. Service Providers We Rely On

The Site relies on the following third-party services, each of which maintains its own privacy practices:

  • Vercel: website hosting and infrastructure (United States);

  • Supabase: database and authentication infrastructure (United States);

  • Guesty: our reservations platform for vacation rental bookings and guest management;

  • Stripe: payment processing for bookings (PCI-DSS compliant);

  • Resend: transactional email delivery;

  • Cloudflare: bot and abuse protection on our forms via Cloudflare Turnstile (see Section 5);

  • Google Analytics and Google Tag Manager: usage analytics and reporting, where enabled.

We encourage you to review the privacy policies of these providers to understand how they handle your information.

5. Bot Protection (Cloudflare Turnstile)

We use Cloudflare Turnstile to protect our forms from spam, abuse, and automated submissions. When the Turnstile challenge runs, Cloudflare may collect and process information about your visit, including your IP address, a TLS/SSL connection fingerprint, your browser's User-Agent string, and the site key and associated origin of the page you are on. Cloudflare uses this information solely to determine whether you are a human or a bot and to improve its bot-detection capabilities, and states that it does not use this information to identify individual visitors or to serve advertising. Turnstile may set a token or cookie on your device that is strictly necessary for this security function. For more information, see the Cloudflare Privacy Policy and the Cloudflare Cookie Policy.

6. SMS / Text Messaging

If you provide your phone number and check the applicable consent box, you agree to receive text (SMS) messages from us. We offer two separate, optional types of messaging consent:

  • Account, booking, and customer-care messages: non-marketing messages related to your inquiry, reservation, or account;

  • Promotional messages: marketing messages about offers, properties, and updates.

Consent to receive marketing text messages is not a condition of any purchase or service. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP to any message, and you can reply HELP for assistance. Carriers are not liable for delayed or undelivered messages. We do not share your mobile opt-in information or messaging consent with third parties for their own marketing purposes.

7. Cookies and Tracking Technologies

We use cookies and similar technologies for the following purposes:

  • Strictly necessary: cookies required to deliver the Site and to keep authenticated administrator sessions secure;

  • Security: tokens or cookies placed by Cloudflare Turnstile to distinguish humans from automated traffic;

  • Payments: cookies set by Stripe when you complete a booking, used for fraud prevention and to process your payment;

  • Analytics: where enabled, cookies and identifiers used by Google Analytics and Google Tag Manager to understand how visitors use the Site so we can improve it.

Most browsers allow you to refuse or delete cookies through your browser settings. You can also opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on. Disabling certain cookies may affect Site functionality.

8. Data Retention

We retain personal information for as long as needed to fulfill the purposes described in this Policy, comply with our legal obligations, resolve disputes, and enforce our agreements. When we no longer need information, we delete or anonymize it.

9. Security

We use reasonable administrative, technical, and physical safeguards designed to protect the information we collect, including encryption in transit and access controls. No method of transmission over the internet or storage system is completely secure, however, so we cannot guarantee absolute security.

10. Your California Privacy Rights

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, "CCPA"), gives you the following rights regarding your personal information:

  • Right to know the categories and specific pieces of personal information we have collected about you, the sources of that information, the purposes for collecting it, and the categories of third parties with whom we have shared it;

  • Right to delete personal information we have collected from you, subject to legal exceptions;

  • Right to correct inaccurate personal information we maintain about you;

  • Right to opt out of the "sale" or "sharing" of your personal information (we do not sell or share personal information as those terms are defined under the CCPA);

  • Right to limit the use of sensitive personal information (we do not use sensitive personal information for purposes that trigger this right);

  • Right to non-discrimination for exercising any of these rights.

Categories of personal information we have collected in the past 12 months: identifiers (such as name, email address, phone number, and IP address); commercial information (such as bookings and inquiries); internet or other electronic network activity information (such as browsing and usage data); and the contents of communications you send us through forms. We collect this information directly from you and automatically through your use of the Site.

To submit a request to exercise any of these rights, please email info@everblueprops.com. We will verify your request before responding and will respond within the time period required by law. You may also designate an authorized agent to make a request on your behalf.

11. Children's Privacy

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected such information, we will delete it. If you believe a child has provided us with personal information, please contact us at info@everblueprops.com.

12. International Visitors

The Site is operated from the United States. If you are visiting from outside the United States, please be aware that your information will be transferred to, stored, and processed in the United States, which may have data-protection laws different from those in your country.

13. Changes to This Policy

We may update this Privacy Policy from time to time. The "Last updated" date at the top reflects the most recent revision. We encourage you to review this Policy periodically.
